Terms of sale

The terms on which we sell equipment to business customers. If we have agreed something different with you in writing, that agreement takes precedence.

1.Who we are

Doughline is a trading name of Net Papi Ltd, a company registered in England and Wales under company number 15895604, with its registered office at 7 Bell Yard, London, WC2A 2JR. You can reach us on 07927 203369 or at hello@doughline.co.uk.

These terms apply to every sale of equipment by us unless we have agreed something different with you in writing.

2.Business customers

We sell to businesses. By ordering you confirm you are buying in the course of a business, and that the consumer rights that would apply to a private buyer do not apply to this sale.

3.Condition of the equipment

Our equipment is used and refurbished unless we describe it otherwise. Used equipment carries cosmetic wear. We describe the condition of each machine, including any known fault, in its listing, and we will answer any question about condition before you buy.

Photographs show the actual machine wherever possible. Where a listing shows a representative photograph we will say so.

Machines are tested and run before dispatch. Where a machine is sold untested, as spares or repairs, or with a known fault, the listing says so and the price reflects it.

4.Prices and payment

Prices exclude VAT and exclude delivery and installation unless stated. VAT is charged at the prevailing rate.

Unless we have agreed credit terms with you in writing, payment is due in full in cleared funds before the equipment leaves us or is collected.

Where we have agreed credit terms, payment is due within 30 days of the invoice date. We may charge interest on late payment at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998.

5.Retention of title

The equipment remains our property until we have received payment in full in cleared funds, even if it has already been delivered to you.

Until then you must keep it safe, insured, and identifiable as ours, and must not sell it or use it as security. If payment is overdue, or if you become insolvent, we may require you to return it and may enter any premises where it is kept to collect it.

Risk in the equipment passes to you on delivery or collection, whichever happens first. Title and risk therefore pass at different times, and you should insure the equipment from the moment it reaches you.

6.Delivery, collection and installation

Collection is from Wood House Farm, Rodsley Lane, Ashbourne, DE6 3GS, by appointment only. Please arrange a time with us before travelling.

Delivery dates are estimates. We will always tell you promptly if a date is going to move, but we are not liable for delay caused by events outside our reasonable control.

You are responsible for telling us before delivery about anything that affects access: door widths, stairs, lift sizes, floor loading and parking. If a delivery cannot be completed because access was not as described, we may charge the cost of the failed delivery and of redelivery.

You are responsible for the services a machine needs, including electrical supply and phase, water, drainage and ventilation, unless we have agreed in writing to provide them. Where we install, installation covers connecting the machine to services already in place and working.

7.Checking the equipment when it arrives

Please inspect the equipment as soon as it arrives. Tell us within 3 working days of delivery if anything is damaged, missing, or not as described.

We cannot investigate transit damage reported later than that, because the carrier will not accept a claim after their own deadline.

8.Warranty

Unless the listing says otherwise, refurbished equipment is covered for 3 months from delivery against mechanical and electrical failure that was present at the point of sale.

The warranty does not cover consumable parts, seals, filters, descaling and water-quality related failures, damage from misuse, unauthorised repair or modification, or normal wear.

If a machine fails within the warranty period, contact us first. We will repair it, replace it, or refund it, at our option. Do not instruct a third-party engineer without our agreement, as we cannot cover work we did not authorise.

Equipment sold as untested, as seen, or as spares or repairs is sold without warranty. The listing will say so clearly.

9.Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that, our total liability in connection with a sale is limited to the price you paid for the equipment, and we are not liable for loss of profit, loss of business, loss of production or any indirect or consequential loss.

You are responsible for satisfying yourself that a machine is suitable for your intended use and site before you buy it. We are happy to advise, and we do so in good faith, but advice is not a guarantee of suitability.

10.Cancellation and returns

Because we sell to businesses, there is no automatic right to cancel. If you want to cancel an order before delivery, contact us and we will tell you what is possible and what costs have already been incurred.

We do not accept returns of correctly described equipment simply because it is no longer wanted. Where we do agree a return, the equipment must come back in the condition it left us and carriage is at your cost.

11.Governing law

These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
